How a claims-made policy works

SOSPOSA Shield is a claims-made policy — this is what that means in practice.

When you're covered

The policy must be in force when a claim is made against you. The event itself can have happened earlier — as far back as your retroactive date — but the claim must arrive while you're covered.

Retroactive date

This is the date you first took out claims-made cover. Genoa matches your previous insurer's retroactive date so there are no gaps. It means past work is covered too — not just from today forward.

Report within 30 days

When you become aware of a complaint, incident or potential claim, notify Genoa within 30 days. They record it as a circumstance immediately and assign legal support — even before a formal claim arrives.

Extended reporting (ERP)

If you retire, emigrate, become disabled, or pass away, the policy gives you (or your estate) up to 60 months of extra time to report claims. This is built into the standard premium — no extra cost after 36 months of continuous cover.

Keep your cover continuous. A claims-made policy only works if you renew annually. If the policy lapses and a claim arrives later, there is no cover — even if you were insured when the work was done. This is why the ERP exists: it protects you after you stop practising.

International members: SOSPOSA Shield operates under South African jurisdiction and is available to South African practitioners only. International members have full access to courses, events and CPD.

Do I need to apply separately for Shield?
No. SOSPOSA Shield is included automatically with every South African membership. When you join SOSPOSA, the Shield benefit is already part of your membership. Alphabelle will contact you via shield@sosposa.co.za with your individual quote. If you prefer not to participate, you can opt out by unticking the Shield checkbox on your membership form.
Who is eligible?
All South African SOSPOSA members — Academy, Associate and Appraised. Your discount depends on your tier: Academy 5%, Associate 10%, Appraised up to 30%. International members are not eligible as Shield operates under South African jurisdiction.
What exactly does the policy cover?
Professional indemnity and medical malpractice claims arising from your sedation practice. This includes legal defence costs, settlement or judgment amounts, and medico-legal support from first notification through to resolution. Cover limits range from R1,000,000 to R50,000,000 depending on your risk profile.
What does "claims-made" mean?
It means the policy must be active when the claim is made against you — not just when the incident happened. The incident itself can have occurred any time after your retroactive date. The practical effect: you must keep the policy in force continuously. If you let it lapse and a claim comes in later, there is no cover, even if you were insured at the time of the procedure.
What is a retroactive date?
The retroactive date is the date you first took out claims-made cover. When you move to Genoa, they match your previous insurer's retroactive date so there is no gap. Any incident that occurred on or after your retroactive date is covered — as long as you have a current policy when the claim is made.
What happens if I retire or stop practising?
The policy includes an Extended Reporting Period (ERP) of up to 60 months at no extra cost. This gives you (or your estate, in the case of death) extra time to report claims after you stop practising. The ERP scales with how long you've held continuous cover: 36 months after 12 months of cover, 48 months after 24 months, and 60 months after 36 months. Triggers include retirement, emigration, permanent disability, or death. If 60 months isn't enough, an Additional Extended Reporting Period (AERP) can be purchased at the underwriter's discretion.
How quickly must I report a claim?
Within 30 days of becoming aware of a complaint, incident, or anything that might lead to a claim. You don't need to wait for a formal summons — if a patient tells you they're unhappy, contact SOSPOSA Shield immediately. Genoa will record it as a circumstance and assign legal support straight away.
Who handles my claim if something goes wrong?
Genoa Underwriting Managers handles claims directly. They appoint specialist medico-legal counsel from top SA firms (including Clyde & Co, Webber Wentzel, CoxYeats, and others), manage the matter proactively, and provide personal support throughout. They also offer a 24/7 medico-legal support line and access to experienced advisers for the psychological impact of complaints.
What does it cost?
Premiums are individually risk-rated based on your qualifications, experience, practice scope and SOSPOSA tier. There is no standard price list — Alphabelle assesses each member individually and provides a personalised quote. Your SOSPOSA tier discount (5% / 10% / up to 30%) is applied on top of the individual assessment.
What happens when I upgrade my SOSPOSA tier?
Your discount improves automatically. When you move from Academy to Associate, or from Associate to Appraised, SOSPOSA Shield is notified and your premium is reassessed at the higher discount level. You don't need to do anything — it happens as part of your tier change.
Can I opt out?
Yes. Shield is included by default, but you can opt out by unticking the Shield checkbox on your membership form. If you've already joined and want to opt out, email shield@sosposa.co.za and we'll update your preference. Opting out means Alphabelle will not contact you and no quote will be generated.
Is there any obligation to accept the quote?
None. Receiving a quote is automatic, but accepting it is entirely your choice. You are under no obligation.
